OUTC Terms of Use

Outc.org encourages an open exchange of information and ideas. But we cannot and do not review postings made in the public posting areas before they are posted. Anybody may obtain the right to post on outc.org merely by registering and providing an email address, and while outc.org takes measures to deny access to people who have posted objectionable material in the past, these measures are quite easily circumvented by any person intent on posting objectionable material. You may well read or view any given posting or photo before anyone on the outc.org staff does. If you do encounter material that you believe falls into one of these categories, we urge you to report it to us so that we may remove it. But We may not be able to remove it as promptly as you think we should. You can expect the site to include information and opinions from a variety of individuals and organizations other than outc.org. It is easy for people to pose as experts in the public posting areas without having any expertise whatsoever. We do not endorse or guarantee the accuracy of any posting, regardless of whether the posting comes from a user, from a celebrity or "expert" guest, or from a member of our staff. There is no substitute for healthy skepticism and Your own good judgment.

Responsibility for what is posted in the chat forums, and photo galleries on outc.org lies with each user - You alone are responsible for material you post. You agree not to post or transmit any false, defamatory, abusive, obscene, threatening or illegal material, or any other material that infringes on the ability of others to enjoy the outc.org or that infringes on the rights of others. You agree to conform to outc.org's polices and guidelines concerning the size, length, format, subject, content, or relevancy of the materials You submit.

Although outc.org cannot monitor all the postings in the forums, and photo galleries, we reserve the right (but assume no obligation) to delete, move, or edit any postings that come to our attention that we consider unacceptable or inappropriate, of for any other other reasons, which we need not disclose, at our discretion and convenience.

Intellectual Property Rights

You will not use the Site to violate anyone's copyright, trademark, intellectual property rights, or privacy rights. The content which you submit must be Your work in its entirety. You may not submit content which is an amalgam of the works of several persons, even if You are among those persons, even if You are the principal creator, or even if the other authors have given You permission to use their work as part of the collective work. By submitting material to outc.org, You are representing that You are the sole author of the content in its entirety, that You have the right to submit the material, and in the case of photos that you have obtained any model releases that may be required.

Notwithstanding the foregoing, you may include brief quotations and thumbnail images in your submissions that are permitted under the copyright laws as "fair use", provided you correctly attribute these to their authors. Furthermore, when commenting on photos in the photo Gallery, you may include a version of the photo under discussion in your comment, altered or marked up to illustrate your comments. By uploading photos to the photo gallery, you grant to other outc.org members permission to copy the photo, to make such alterations and markups for the purpose of commentary as they see fit, and to attach tthe modified photo to their comments on the photo.

Submitting material that is the property of another, without the consent of its owner, is not only a violation of this agreement, but may also subject You to legal liability for infringement of copyright, trademark, or other intellectual property rights.

If material in which you hold intellectual property rights, which infringes your privacy, or which is defammatory is unlawfully submitted to outc.org by a third party, please inform us immediately and we will remove it.

Submission of material to outc.org forums, does not transfer the copyright to that material to outc.org. However, by submitting the material, You grant outc.org and its successors or assigns a perpetual non-exclusive world-wide royalty-free license to publish that material on the World Wide Web as part of the outc.org web site.

Your posted materials will be attributed to the name under which you are registered on the site. If the name under which you are registered on the site is modified, your posts will be attributed either to the name you had on the site when you originally registered, to the name you had on your account at the time of the post, or to your current name on the site, at outc.org's discretion.

You grant outc.org, its employees, its volunteer editors and moderators, and other persons who may be designated by outc.org, permission to edit, modify, or to reformat your textual materials, including extensive modifications with which you may not agree, without your prior approval, and you grant outc.org permission to publish the modified work as part of the outc.org web site. Words or phrases in your posts may be converted into hypertext links either manually or by means of automatic software, and citations, cross-references, parenthetical comments by editors, and hyperlinked words or phrases may be inserted into your material. Some of these links may represent paid advertising by third parties. Your posted material may be amalgamated with that of other posters, or summarized in words not of your choosing, or only portions retained. In meeting the requirement that your material be attributed to you, it shall be sufficient that you are listed as an author/contributor in a history of the article, comment or forum thread, discussion, etc, to which you contributed the post. But it is not required that the original text of each contributor to an article, forum thread, discussion, etc be immediately apparent to a reader, or even that it be possible for a reader to reconstruct your original text. For example, an editor may take a forum thread to which you have contributed and summarize and blend the contributions, including yours, so that the integrity of your material is not maintained, and the end result may have a tone or gist different from your original post, and with which you may not agree. Note that this provision allows your post to be used in a "wiki" format, even though the area to which you posted it may not have been a wiki when you posted it.

Your post may be quoted at length in other posts on outc.org. In the process of alerting people that you and/or others have posted material on the site, outc.org may send copies, extracts, digests, or thumbnails of your material to third parties via electronic or postal mail. If you object to any modification of a particular post of yours, upon request via email outc.org will, at its discretion, either remove your copyrighted material, or insert a notice near the material that it has been modified.

With respect to photographic and other visual works, outc.org will not modify your works without your permission, other than to create multiple versions with different dimensions and file sizes, or to change technical characteristics such as the encoding or file representation. For example, a JPEG file may be changed to a PNG file an image file may be converted to a color space more suitable for web display or sections of the image file other than the main image, such as EXIF or preview data, may be removed.

Many of the posting areas of the site, including the Gallery, provide You with the ability to delete or edit your posts after their original submission. Some areas of the site are labelled "non-archived", and a policy of automatic deletion is in effect. Your grant of license to outc.org for the use of your material is not conditioned on these editing/deleting features being maintained as they were when you submitted the material, and outc.org reserves the right to alter or eliminate these features, or to transfer or replicate your submissions to areas of the site where the editing/deleting/archiving features are not the same as the area to which you originally submitted the material, or to use the material in a section of the site other than the one where you posted it and from which you may not be able to delete it. Also, outc.org maintains backups of all material on the site. Your use of an editing/deleting feature to remove or change the material you have submitted in general will not remove or change the material on any backups that have been created, and in the event that the backups were used to restore the content of the site, for example after a disaster, your edits/deletions could be undone. If you are concerned about this possibility, you should check occasionally after removing or editing material that the original has not been restored from a backup.

You grant to other outc.org users and site visitors the right to make a temporary copy of your material in the course of viewing or reading it with a standard Web browser, or RSS reader. In addition, outc.org may grant permission to third parties, including without limitation operators of proxy servers, caching servers, search engines, web site directories, digesting and aggregation services, syndication services, portal sites, or Internet archiving sites, to make copies of the content of outc.org from time to time, and by submitting your material to outc.org, you grant permission to outc.org to authorize such third parties on your behalf to copy your submitted materials and you agree to such usages of your material by third parties as may be authorized by outc.org. Search engine operators, digesting services, Internet archiving sites, and other third parties to whom outc.org grants permission to copy your material may also cache the content they have copied from outc.org on their own web sites, and make it available to their visitors and subscribers on their web sites. For example, Google provides its users with a cache of the pages from which indexed results were generated. These copies may also be modifications or works derived from your original material, such as digests, extracts, or thumbnails. By posting material to outc.org, you grant permission also for this usage of your material by third parties who have been authorized by outc.org. Your use of editing/deletion features on outc.org to remove or change content you have posted on outc.org may not necessarily result in the copy of the material being maintained by a third party being changed or deleted, and it may not be possible ever to remove your material from the third-party site, even though outc.org permits you to remove it from the site. By submitting your material to outc.org, you acknowledge and agree to this.

No Soliciting

You agree not to use the Site to advertise products or services or to solicit anyone to buy or sell products or services, or to make donations of any kind, without our express written approval.

No Spamming/Email Address Harvesting

From time to time, users post their email addresses in our forums, and the site makes available the email addresses of members to other logged-in members. You agree not to gather these email addresses for purposes of spamming or for any non-personal or commercial purposes.
